On 25th January the High Court rejected the Governments appeal for the proposed Feed in Tariff drop effective from 12th December 2011. In the meantime the Government have put forward legislation to parliament to drop Feed in Tariffs from the 3rd March. It remains possible that the Government may appeal to the Supreme Court, but in the meantime the previous Feed in Tariff Rate at 43.3p / kWh for domestic installations still holds and will do so until 3rd March 2012.
What does this mean for potential PV installations?
It seems that we are going to have another gold rush until 3rd March. This is good news for those who want small domestic installations without planning applications and network operator consents. For larger commercial and farm installations it seems unlikely that consents for these installations would be in place by the 3rd March. However, for those who were already in the process but were caught out by the 12th December deadline, planning permissions etc should now be in place, so the potential remains for some commercial installations to go ahead as planned at the higher FIT rate.
